High Court dismisses Jamilu Mukulu's petition
The High Court in Kampala has dismissed jailed ADF leader Jamilu Mukulu's petition to have his trial dismissed on the grounds of torture and human rights violations. This followed an application to the International Crimes Division court, filed three years ago, in which he challenged the legality of the terrorism charges against him. He asked the court to declare his trial a nullity and set him free, arguing that he was being charged with offences that were not part of his extradition from Congo. Mukulu, who has been on remand since 2017, also failed to prove to the court that he had been tortured during his detention.
He claimed that the trial had been delayed and that his property, including USD 38,000 and a camera, was confiscated. However, he also failed to prove that he was detained in police cells beyond the 48-hour constitutional limit before being remanded. He further claimed that his rights were abused when he was paraded before the media.The High Court rejected the petitioner's claims, stating that the alleged violations were not substantial enough to warrant termination of the trial.
