Godfrey Kato Kajubi was sentenced to life for the murder 12-year-old Joseph Kasirye. In his ruling, Justice Mike Chibita said the prosecution produced “enough evidence” to prove beyond reasonable doubt that the businessman participated in the murder.
MASAKA. The High court Judge in Masaka has dismissed an application filed by Kato Kajubi's Lawyer Musa Ssembajja of C.Mukiibi Ssentamu and Co.advocates seeking orders to have Kato Kajubi freed and his murder case heard again.
Kajubi was convicted and sentenced to life imprisonment after being found guilty of hiring Umar Kateregga a witch doctor and his wife Mariam Nabukeera to sacrifice 12-year-old Joseph Kasirye in 2008.
In his application, Ssembajja challenges the Director of Public Prosecutions subjecting Kajubi to an unfair trial when they decided to bring Kateregga and Nabukeera as accomplice witnesses. To Ssembajja, the two are accused persons in the matter.
Ssembajja sought the court to quash his client's conviction, have the life imprisonment set aside, and be released from prison. He has asked the court to retry Mariam Nabukeera and her husband Kateregga.
But her Lordship Victoria Nakintu, in her ruling, says that the applicant seems to challenge a trial that was already determined by a higher court - the court of appeal.
She notes that her court has no jurisdiction to re-appraise the same matter thereby dismissing the case with no costs.
However, Ssembajja insists that he is going to seek justice in the East African Court of Justice.
