Court dismisses Bobi Wine attempt to block new car evaluation

Tuesday April 06 2021

URA can now go ahead to impound and re-examine National Unity Platform’s (NUP) President Robert Kyagulanyi Ssentamu's new motor vehicle after the High Court dismissed his application seeking for an injunction against URA.

According to the high court, Kyagulanyi has not adduced evidence to show that the re-calling of the said motor vehicle would cause him an irreparable injury which cannot be compensated by an award of damages.

Justice Emmanuel Baguma made this finding and further ruled that the Court was not satisfied with Kyagulanyi's claim that his main worry or concern not to take back the said vehicle for re_verification was that it is his main means of transport and his personal security.

The Judge, therefore, declined to grant the temporary injunction against URA and dismissed the application as improper.

He made no orders to costs.

Geoffrey Turyamusiima who represented Kyagulanyi in this case on 4th March 2021 informed Court that his client was ready to have his newly acquired motor vehicle a Toyota Land Cruiser re-examined by URA; but that it should be done at his home in Magere in his presence.

However, URA's Geoffrey Balamaga a Manager in the Customs Department objected to Magere, insisting that the law governing re-assessment of goods under the East African Community customs Management Act 2004 only permits them to assess and evaluate goods before the Commissioner Customs.
