High court orders for Dr Nyanzi’s immediate release

The High Court - International Crimes Division has, on Thursday, ordered for the immediate release of Makerere researcher, Dr Stella Nyanzi from Luzira prison for being subjected to an illegal trial.

Dr Nyanzi who appealed to the high court in August 2019 over a conviction by the Buganda road court Grade one Magistrate Gladys Kamasanyu Musenze sentencing her to 18 months in Prison is now set to be freed after Justice Dr Henry Peter Adonyo of the High court quashed her conviction on cyber-harassment.

“Buganda road court lacked jurisdiction to try her,” Justice Adonyo said during the court session at the high court.

Justice Adonyo, also pointed out that the magistrate at the Buganda road court denied Dr Nyanzi the right to properly prepare a defence for herself.

“Her right to a fair trial was violated when the magistrate denied her a right to identify, prepare and cause the compulsory attendance of her defence witnesses,” said Justice Adonya.

Justice Adonya says that the lower court lacked the authority to try the case in absence of scientific evidence to prove the location or what gadget Dr Nyanzi used to upload the contentious abusive post that allegedly offended the person of the President and his mother the late Esteri Kokundeka.

On August 2, 2019, Buganda Road Court Grade One Magistrate Gladys Kamasanyu Musenze sentenced Nyanzi to 18 months in prison after she was convicted of cyber harassment contrary to sections 24(1) and 24(2) (a) of the Computer Misuse Act (2011).

It should be noted that Dr Nyanzi's 18 months imprisonment term was due to end this Saturday, 22nd February 2020. By the time of her conviction, she had already spent 9 months on remand.

While in Prison, Dr Stella Nyanzi wrote a book titled “No Roses From My Mouth” which she proudly showed off before her ruling at the International War crimes Division of the high court on Thursday.
