Magistrate acquits DPs Moses Bigirwa

LDC Court Grade One Magistrate Roselyn Nsenge has directed the unconditional release of Democratic Party’s Moses Bigirwa from Prison, after discovering that he had been charged under a law that was repealed by the Supreme Court in 2002.

Magistrate Nsenge made the order as she delivered a ruling on whether to release Bigirwa on bail. However, the magistrate asked why neither Bigirwa’s lawyers nor the prosecution had the raised the anomaly during his arraignment in court.
The defence team including MP Asuman Basalirwa and DP's Kenneth Paul Kakande asked the magistrate to close the case file, but prosecution instead asked for an adjournment for DPP's opinion, which prompted the magistrate to adjourn the matter to January 28th 2019 for ruling on whether to refer the matter to a higher court.
Bigirwa was recently picked up after he made comments on radio over last year’s the Arua by-elections.
