Abdallah Kitatta's Court martial trial resumes, says Golden Pistol is not his

Tuesday July 17 2018

The trial of Boda-Boda 2010 patron Abdullah Kitata resumed before the General Court Martial on Tuesday, 17 2018, after a one month's suspension following the expiry of the court members' term of office.

Kitatta and a group of 12 boda-boda riders are on trial before the Army court on charges of being in unlawful possession of firearms, live ammunition, Military head gears and uniforms.

The court resumed with the cross-examination of prosecution's first witness; private Richard Kasaijja by Kitatta's three lawyers led by Shaban Sanya.

Even though prosection first indicated to the court that it had not summoned private Kasaijja to appear for cross-examination, but in a twist of events, when the case was stood over for one hour to enable defence lawyers to interact with their clients, private Kasaijja appeared and took the stand ready to be cross-examined.

However, was been drama in court when the court's chairman Lt. Gen Andrew Gutti attempted to throw Kitatta's lawyers out of court accusing them of foolery.

This is after the lawyers told Lt. Gutti that they are unable to answer on behalf of their clients whether they have an objection to any of the newly sworn in court members to preside over their case.

This angered Lt. Gutti dubbing the lawyers as unserious having given them ample time to brief their clients.

Later on, Gutti excused the lawyers and asked each individual if they had a problem with any of the members on the bench, to which they answered in the negative.

The lawyers asked Kasaijja about his evidence he gave on the 21st/May 2018 regarding the arrest of the suspects on the 20th/January 2018, and Kitatta's golden pistol which he displayed in court.

During his testimony in May, private Kasaijja displayed 3 guns, live ammunition, Military uniforms and caps that he allegedly discovered from a Hotel room at Wakaliga where Kitatta was hiding.

However, the defence team says the golden pistol and the ammunition were planted by CMI in Kitatta's hotel room and therefore want an order from the court to retrieve the CCTV footage from Vine Hotel to disprove Kasaijja's testimony.

Prosecution states that Kitata and 12 others in January 2018 were arrested from Vine Hotel with an SMG gun, 3 pistols, 50 rounds of live ammunition and Military gear which are a monopoly of the UPDF.
